A recent inquest into the death of an 11 year old killed by a drunk tractor driver
heard that Police were unable to prosecute because the incident occurred on a farm in an area not open to the public and therefore outside the scope of Road Traffic Act legislation. The loophole is set to be closed by EU legislation as a result of a Ukrainian tractor case where Vnuk was injured on a farm; too late to prosecute the UK culprit, although he and his employers could still face prosecution under Health and Safety legislation and civil proceedings for compensation.
